The underlying incident occurred June 4, 2016 at a bus stop serviced by the City of Santa Monica, where the plaintiffs’ sole surviving adult daughter awaited the Route 3 bus. The decedent was struck and crushed by the bus while attempting to board and as the bus moved away from the curb after servicing the stop; she died later that night. Discovery established that internal policies required bus operators to maintain a regular and clear line of sight along the side of the bus which struck the decedent. Defendants contended alcohol was a contributing factor to the incident. Plaintiffs countered that the intoxicated are encouraged to take public transportation and are a foreseeable class of patrons.
