Plaintiff A.P. was a contractor performing electrical work in an elevator of a building. Unbeknownst to him, the electrical input had been improperly grounded, and he was fatally electrocuted. His family sued for wrongful death; due to vicarious liability, the defendants included many parties such as the building owner, current tenant company, the owner of the company, and several contractors and their owners.
Defendants heavily contested employer liability, gross negligence, and future wage loss due to the electrical contractor’s age. Despite this, Plaintiffs achieved a global settlement of $1,395,000. for the surviving family.
