Plaintiff John Doe was riding his motorcycle down a residential street in the morning when he approached a stop sign. At the same time, a delivery van approached the intersection, suffered a brake malfunction, and was unable to stop at the intersection. Plaintiff subsequently collided into the side of the delivery van and was ejected head first from his motorcycle. As a consequence, plaintiff endured a traumatic brain injury and a seizure disorder.
Plaintiff sued the owner of the van and the transport company for negligent operation of the vehicle, also claiming that they were vicariously liable for the driver’s actions, as the driver was in the course and scope of his employment at the time of the incident.
The law suit ultimately settled at mediation for $1.5 million.
