Plaintiff C.H. was an inspector for a District Attorney’s Office. Over a ten month span, C.H. was involved in three separate rear-end vehicle accidents, each occurring while in the course and scope of her employment. After this period, she received a significant promotion. Unfortunately, the three accidents caused painful and indivisible injuries to her cervical spine, including a degenerative disc, desiccation and osteophytes. Consequently, C.H.’s suffering prevented her from carrying out the duties of her new station, and she was forced into early medical retirement.
The driver of the third accident settled with C.H. on the second day of trial for $700,000. On the third day, the first driver settled with C.H. for $75,000. Trial proceeded against the second driver, resulting in a judgment in favor of the C.H. for $1,700,000.
