While defendant Hanford admitted liability, she contested plaintiff’s damages, claiming that plaintiff Capote only suffered minimal, soft-tissue injury due to the low-speed of the impact.
Plaintiff Cindy contended that the collision caused an asymptomatic, pre-existing condition to become symptomatic.
At trial, the jury awarded Cindy $690,927.37. Motions continued after trial, and plaintiff Capote eventually won a settlement for $850,000.
