In July 2020, Plaintiff was involved in a five-car collision on Hwy U.S. 101. Plaintiff suffered serious physical and cognitive injuries when an SUV failed to notice the stopped traffic and smashed into the back of Plaintiff’s vehicle.
The injuries to Plaintiff’s body were extensive and caused her severe pain. Plaintiff required reconstructive shoulder surgery and long-term care of her neck. Unfortunately, Plaintiff developed complications after surgery and was given a recommendation for a second shoulder surgery. The injuries to her shoulder and neck were permanent.
As a result of the trauma to her head and loss of consciousness at impact, Plaintiff also suffered a brain injury and developed post concussive syndrome.
Plaintiff’s physical and cognitive limitations from her injuries resulted in her becoming unemployed and she was let go from her job. At the time of the collision, Plaintiff was a single mother to her young son. She faced a life time of care and limitations.
The defendant who was responsible only had a $25,000 insurance policy. The Plaintiff’s own insurance carrier attempted to deny Plaintiff from her right to receive the benefits of the underinsured motorist insurance contract. Plaintiff’s attorneys had to litigate the UIM claim with the insurer which was attempting to argue that the collision was not the cause of her injuries.
The claim settled before arbitration for the full policy limit. Between the third- and first-party policies, a $500,000 settlement was recovered.
